At its meeting on November 9, the Verkhovna Rada adopted draft law No. 9627 "On Amendments to Some Legislative Acts of Ukraine to Attract Investments for the Rapid Reconstruction of Ukraine."
The purpose of the draft law is to create favorable conditions for the implementation of investment projects aimed at restoring the economy of Ukraine in the war and post-war periods.
The bill envisages changes to the legal acts regulating the specifics of land relations during martial law, in particular, a simplified procedure for determining and changing the purpose of land plots.
The amendment proposes to simplify the procedure for establishing and changing the purpose of land (except for lands of the nature reserve fund and other nature conservation purposes, lands of historical and cultural purpose, lands of the water fund, recreational and forestry purposes) in the territories outside the settlements, in the event that in relation to such territories there is no approved urban planning documentation for the placement of the following objects:
- industrial buildings and warehouses;
- agricultural, forestry and fishery buildings;
- pipelines, communications and power transmission lines (except main oil pipelines and main gas pipelines);
- complex industrial facilities (except for enterprises and facilities of enterprises for the enrichment and processing of nuclear materials; facilities and furnaces for incineration of waste; nuclear power plants).
In such cases, the change of purpose of land plots will be carried out by the decision of the owner of the land plot based on the reasoned conclusion of the urban planning and architecture authority on compliance with land use restrictions.
The procedure of simplified purpose change for the specified needs is proposed to be applied during martial law and within five years from the day of its termination.
